Our products are designed for those who value craftsmanship, sustainability, and the serene beauty of contained ecosystems.

By using our site, you acknowledge that our products are often delicate, custom, or living/preserved art forms, requiring specific care as outlined in product descriptions and our policies.

2. User Obligations and Responsibilities

As a valued user of our store, you agree to:

• Provide accurate, current, and complete information during account creation and checkout.
• Use the website only for lawful purposes and not engage in any activity that may disrupt its functionality.
• Review all product details, care instructions, and policies before making a purchase.
• Ensure your delivery address is accurate and serviceable. You are responsible for any additional costs or delays due to incorrect addresses.
• Use the purchased products with appropriate care, understanding that improper handling after delivery (e.g., for Preserved Plants, Glass Cloches) may void eligibility for returns.
• Protect your account credentials and notify us immediately of any unauthorized use.

3. Products & Services Description

We take great care to describe and photograph our products accurately. However, please note:

• Natural Variations: As many items feature natural materials like Natural Driftwood and live/preserved plants, each piece is unique. Slight variations in color, shape, or texture are inherent to their beauty and are not considered defects.
• Custom & Final Sale Items: The following items are considered final sale due to their custom, delicate, or perishable nature and cannot be returned or exchanged:
  • All Wedding Terrariums (Black, Gold, Silver, Pink, standard).
  • Preserved Plants.
  • Any Personalized or Made-to-Order items.
• Availability: All items are subject to stock availability. We reserve the right to discontinue any product without notice.

4. Orders & Payment Terms

Placing an Order

Your order constitutes an offer to purchase. Acceptance occurs when we send an order confirmation email. We reserve the right to cancel any order before shipment due to stock issues, pricing errors, or suspected fraud.

Pricing & Payment

• Prices are listed in US Dollars (USD).
• We accept: Visa, MasterCard, JCB, and PayPal.
• Payment is processed securely at checkout. Your card will be charged upon order placement.
• We are not responsible for any foreign transaction fees your bank may impose.

Shipping & Delivery

Risk of loss and title for items pass to you upon delivery to the carrier.

5. Returns, Exchanges & Refunds

Your satisfaction is paramount. Our policy is designed to be clear and fair, respecting the nature of our products.

• Window for Requests: You have 15 days from the receipt date to initiate a return or exchange.
• Condition: Items must be in original, unused, resalable condition with all packaging, tags, and accessories intact.
• Process: All returns/exchanges require prior authorization. Email [email protected] with “Return/Exchange Request” and your order details.
• Return Shipping: You are responsible for return shipping costs unless the return is due to our error. We strongly recommend using a trackable, insured service.
• Refunds: Upon approval, refunds are processed within 7-10 business days to the original payment method.
  • The item price is fully refunded.
  • Original shipping fees are non-refundable.
  • For orders that used Free Shipping (EMS) over $50, a deduction of $12.95 may be applied to cover the initial outbound shipping cost.
• Please refer to the “Final Sale Items” list in Section 3 above for non-returnable products.

All content on this website, including but not limited to text, graphics, logos, images, photographs, and product designs (such as our Geometric Terrariums and Brass and Glass Frames), is the property of NCYP Garden Store or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

7. Limitation of Liability

NCYP Garden Store and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the website or our products.

Our total liability for any claim arising from your purchase shall not exceed the total amount you paid for the specific product(s) in question. This limitation applies to the fullest extent permitted by law.

We are not liable for delays or failures in performance due to causes beyond our reasonable control (force majeure), including acts of nature, war, embargoes, or failures of our shipping partners.

8. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Fresno County, California.
